The Material Girl went on record Thursday to say that Sean Penn never beat or abused her, according to court papers.
Madonna expressed herself in an affidavit defending her ex-husband as part of an amended complaint in the “Milk” actor’s million defamation lawsuit against director Lee Daniels.
And Penn was last seen being chased by paparazzi as he left for the Palm.
It was Merrick, now a retired justice of the peace, who performed the August 1985 marriage of Madonna Louise Ciccione and Sean “KO” Penn.
“I felt they were serious about their vows,” says Merrick.
“I remember a line from the ceremony: ‘Although there will be times that your moods may falter, and you’ll question each other’s motives, the faith and love that you share will help to show that your inconsistency is only for the moment.’ ” Trouble is, for Sean, 27, and Madonna, 29, that moment seemed to persist for a little over two years.

In her statement, Madonna calls Penn “a caring, compassionate individual, as well as an extremely talented actor.” Madge filed an assault claim against the “Fast Times at Ridgemont High” actor in Los Angeles in 1989, but later withdrew the complaint.
“I am aware of the allegations that have surfaced over the years accusing Sean of incidents of physical assault and abuse against me,” Madonna wrote.
That’s a sign of the time, of race, of where we are right now in America,” Daniels told the Hollywood Reporter.
